Terms of Service

1. Agreement and eligibility

These Terms form an agreement between you and LuxeAI Agency, LLC (“LuxeAI,” “we,” “us,” or “our”). By accessing the service, you confirm that you are at least 18 years old, can enter a binding contract, and will use the service only where lawful. The service is private and invite-only; an invitation does not guarantee acceptance or continued access.

2. Accounts and security

You must provide accurate information, protect your credentials, and promptly report suspected unauthorized access. You may not share, transfer, sell, or impersonate an account. We may require identity, age, consent, or ownership verification before enabling features or processing content.

3. Creator programs and signed agreements

Creator-sale services and AI-training participation require separate electronic agreements. Those signed agreements govern compensation, licenses, AI-likeness consent, withdrawal, and program-specific obligations. If these Terms conflict with a signed program agreement, the signed program agreement controls for that subject.

4. Your content

You retain ownership of content you lawfully own. You grant only the rights stated in the program agreement you accept and the permissions reasonably necessary to host, secure, review, process, and deliver the service. You represent that every depicted person is an adult, consented to the creation and authorized use of the content, and that you can provide supporting records on request.

5. Prohibited conduct

• Content involving or sexualizing anyone under 18, or anyone presented as under 18.
• Nonconsensual intimate imagery, sexual exploitation, trafficking, coercion, hidden-camera material, or content uploaded without required performer consent.
• Content that infringes copyright, privacy, publicity, trademark, or other rights.
• Malware, credential theft, security testing without written permission, scraping, reverse engineering, or bypassing access controls.
• Using generated or altered media to impersonate a real person without documented authorization.

6. Review, removal, and preservation

Uploads may be quarantined, reviewed, rejected, restricted, preserved, or removed for safety, legal compliance, contract administration, or enforcement. Approval is not a promise that content will be published or commercially successful. We may preserve records when reasonably necessary for disputes, fraud prevention, legal holds, age/consent verification, or applicable recordkeeping duties.

7. Fees and third-party services

Program compensation and fees are described in signed agreements and issued statements. Third-party platforms, storage, email, payment, and infrastructure providers have their own terms. LuxeAI is not responsible for third-party outages, policies, account actions, or payout decisions outside our control.

8. Suspension and termination

You may request withdrawal as provided in your signed agreement. We may suspend or terminate access for legal or safety risk, breach, fraud, nonpayment, or platform integrity. Provisions that by their nature should survive—including ownership, accrued payment duties, record preservation, disclaimers, and dispute terms—remain effective after termination.

9. Disclaimers and liability

The service is provided “as is” and “as available” to the extent permitted by law. We do not guarantee uninterrupted operation, revenue, audience growth, platform approval, or preservation against every possible threat. To the maximum extent permitted by law, LuxeAI will not be liable for indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms excludes liability that cannot legally be excluded.

10. Governing law and changes

Florida law governs these Terms without regard to conflict-of-law rules. Disputes not resolved informally will be brought in a court with jurisdiction in Florida, unless applicable law requires otherwise. We may update these Terms prospectively and will provide notice of material changes through the service or your contact information. Continued use after the effective date constitutes acceptance where permitted by law.
